If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

NexMock provides online mock tests, practice exams, study materials, and related educational content designed to help users prepare for various competitive examinations and assessments. The Services include:

4.2 Service Availability

While we strive to provide uninterrupted access to our Services, we do not guarantee that the Services will always be available, error-free, or free from interruptions. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

5.2 Payment Methods

We accept various payment methods, including credit cards, debit cards, net banking, UPI, and other digital payment options as indicated on our website. By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

5.3 Payment Processing

All payments are processed through secure third-party payment gateways. NexMock does not store complete credit card or banking information on our servers. You agree to pay all charges incurred by you or on your behalf through the Services, at the prices in effect when such charges are incurred.

5.4 Subscription Services

Some of our Services may be offered on a subscription basis with recurring billing. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel your subscription. Subscription fees are billed in advance and are non-refundable except as required by law.

6. No Refund Policy

By making a purchase on NexMock, you expressly acknowledge and agree to our strict no-refund policy. This policy applies to all products and services, including but not limited to:

• Test bundles and packages
• Subscription plans (monthly, quarterly, or annual)
• Study materials and downloadable content
• Premium features and add-ons

6.1 No Exceptions

Refunds will not be provided under any circumstances, including but not limited to:

• Change of mind or buyer’s remorse
• Dissatisfaction with test content or difficulty level
• Technical difficulties or user error
• Failure to use the purchased services within the validity period
• Duplicate purchases
• Inability to access services due to user’s internet connectivity issues
• Academic performance or examination results

6.2 Due Diligence

Before making a purchase, we strongly encourage you to:

• Verify system requirements and compatibility
• Ensure you have selected the correct product or subscription plan

6.3 Subscription Cancellations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXMOCK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Examination failures or academic setbacks
• Interruption of business or services
• Cost of substitute services

ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless NexMock and its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Your violation of any applicable laws or regulations

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. You consent to the personal jurisdiction of such courts.

12.3 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us to attempt to resolve the dispute informally. We will make good faith efforts to resolve any disputes amicably.

13. Modifications to Terms

We reserve the right to modify these Terms at any time, at our sole discretion. Any changes will be effective immediately upon posting the revised Terms on our website. We will indicate the “Effective Date” at the top of these Terms.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting our customer support or using the account deletion feature in your settings. Upon termination, your right to access and use the Services will immediately cease.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Fraudulent or illegal activity
• Request by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security reasons

14.3 Effect of Termination

Upon termination of your account:

• All licenses and rights granted to you will immediately terminate

• No refunds will be provided for unused services or subscription periods
• Provisions of these Terms that by their nature should survive termination will remain in effect

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NexMock regarding the use of our Services and supersede all prior agreements and understandings.

15.2 Severability

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, or strikes.
